PROBATE LAW

The period following the death of a loved one can be overwhelmingly difficult and painful. At LaRochelle Luna P.C., we empathize with your situation and provide representation to family members left to distribute the estate of their loved one. If your beloved passed away without a will, we can help. Also, if you have been appointed the task of being the executor(ix) or estate administrator of someone’s will, we will guide you through the entire legal process and assist in the distribution of the deceased’s property and assets.

In general, Texas law establishes the process after the death of an individual, in either probating the will of a deceased person or administering the assets of someone who died without a will. The process will vary from case to case depending on the facts.  No two cases are the same.

Texas law requires that several matters be dealt with after the court hearing. Our office will gather information from our clients so that all probate matters are adequately and promptly handled.

To learn more about how our attorneys can assist you in the probate of a will and what your fiduciary duties are as executor or estate administrator, please contact our Houston office at 713-364-6510.

Our goal is to ensure that each client has a smooth and efficient experience through the probate or administration process. When a loved one passes, the last thing you want to worry about is how to handle dealing with that person’s will on your own.  We are here to help take that burden off your hands.  Ultimately, whatever type of case you may have, our first priority is to ensure that our clients are effectively and efficiently represented at every step of the process while keeping costs reasonable.

Other common forms of litigation in probate courts:

  • suspect the validity of a Will, or whether the person who signed the Will was of sound mind
  • believe a family member or friend exercised undue influence over another
  • concerned about the validity of some creditors claims against the estate

If you need legal help to bring a claim to court, please contact one of our offices and our experienced attorneys will assist you in probate litigation.
